Terms & Conditions

These Terms & Conditions ("Terms") apply to the MyDietPro mobile application ("Application") for iOS and Android devices, developed and operated by MOSH INNOVATION ("Service Provider", "we", "us", or "our"). By downloading, installing, or using the Application, you agree to be bound by these Terms.
 

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on devices that you own or control, solely for your personal, non-commercial use. You may not:

  • Copy, modify, or distribute the Application

  • Reverse-engineer, decompile, or disassemble the Application

  • Sublicense, lease, or lend the Application to any third party

  • Use the Application for any unlawful purpose
     

2. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.
 

3. Subscriptions and Payments

The Application may offer subscription-based features ("Premium Features"). Subscriptions are managed and processed through the Apple App Store (iOS) or Google Play Store (Android), depending on your device.

By subscribing:

  • You agree to the subscription price displayed at the time of purchase

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

  • You can manage or cancel your subscription through your device's app store settings (Apple App Store or Google Play Store)

  • Refunds are subject to the applicable app store's refund policies
     

4. AI-Powered Features

The Application offers optional AI-powered features, including but not limited to AI Food Scan and AI Meal Review.

  • Not medical or dietary advice: AI-generated nutritional information is provided for general informational purposes only. It is not intended as a substitute for professional medical, dietary, or nutritional advice from qualified healthcare professionals or MOH-registered dietitians.

  • Accuracy not guaranteed: While we strive for accuracy, AI-generated results may contain errors or inaccuracies. You should not rely solely on AI outputs for health or dietary decisions.

  • Third-party processing: AI features are powered by third-party AI service providers. Your use of these features is subject to the data handling practices described in our Privacy Policy.

  • No liability: The Service Provider is not liable for any health consequences, dietary outcomes, or decisions made based on AI-generated information.
     

5. User Content

By submitting content through the Application (including food photos, meal descriptions, and profile information):

  • You retain ownership of your content

  • You grant us a non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Application's services

  • You agree not to submit content that is unlawful, offensive, or infringes on any third party's rights
     

6. Food and Nutritional Database

The Application provides access to a database of Malaysian and Asian food items with nutritional information.

  • Nutritional values are approximate and may vary based on preparation methods, portion sizes, and ingredients

  • The database is for informational purposes only and does not constitute dietary or medical advice

  • We make reasonable efforts to ensure accuracy but do not guarantee that all entries are complete or error-free
     

7. Dietitian-Guided Content

The Application may include content described as guided by MOH-registered dietitians.

  • This content is for general educational and informational purposes only

  • It does not establish a dietitian-patient relationship

  • It is not a substitute for personalised advice from a qualified healthcare professional

  • You should consult a healthcare professional before making significant dietary changes, especially if you have underlying health conditions
     

8. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE SERVICE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Application will be uninterrupted, error-free, or secure

  • The results obtained from the Application will be accurate or reliable

  • Any defects in the Application will be corrected
     

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH CONSEQUENCES, OR DIETARY OUTCOMES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION.

In no event shall the Service Provider's total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim, or RM50.00, whichever is greater.
 

10. Indemnification

You agree to indemnify and hold harmless the Service Provider from any claims, damages, losses, or expenses arising from your use of the Application, your violation of these Terms, or your violation of any rights of a third party.
 

11. Termination

We reserve the right to suspend or terminate your access to the Application at any time, with or without cause, and with or without notice. Upon termination, your license to use the Application will immediately cease. You may also terminate your use by uninstalling the Application and requesting account deletion.
 

12. Platform-Specific Terms
 

Apple App Store (iOS)

  • These Terms are between you and MOSH INNOVATION, not Apple. Apple is not responsible for the Application or its content.

  • Apple has no obligation to provide maintenance or support for the Application.

  • In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application.

  • Apple is not responsible for addressing any claims relating to the Application, including product liability, legal compliance, or intellectual property claims.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
     

Google Play Store (Android)

  • These Terms are between you and MOSH INNOVATION, not Google. Google is not responsible for the Application or its content.

  • Google has no obligation to provide maintenance or support for the Application.
     

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating this page with the revised Terms and effective date. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.
 

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Malaysia.
